I. Who we are and what these Terms cover
These terms of service (the "Terms") govern the pre-launch page available at www.artency.com (the "Page") and the waiting list operated through it (the "Waiting List").
The Page and the Waiting List are operated by GLOBENCER SRL, a limited liability company incorporated in Romania, with its registered office at Str. Infratirii nr. 45 A, 410251 Oradea, Bihor County, Romania, registered with the Trade Register under no. J2018000648058, tax identification code (CUI) 39054634 ("Artency", "we", "us", "our"). You can reach us at mihai.pop@globencer.ro.
By subscribing to the Waiting List, including by ticking the "I agree to the Terms of Service" box and submitting your e-mail address, you confirm that you have read, understood and accepted these Terms. If you do not agree with these Terms, please do not subscribe.
II. The Waiting List
Artency is an upcoming online store for wall art, including canvas prints and posters. Before launch, the Page allows you to join a free Waiting List so that we can notify you by e-mail when the store opens.
a) Joining the Waiting List is free of charge and does not oblige you to buy anything, now or after launch.
b) You may submit only an e-mail address that belongs to you.
c) The Waiting List is a notification service only, as described in Section III below.
III. What subscribing does not do
Joining the Waiting List does not create a contract for the sale of any product and does not oblige us to launch the store. In particular:
a) Any countdown or launch date shown on the Page is indicative only. The launch may be moved, postponed or cancelled.
b) We do not guarantee the availability, assortment, features or prices of any products. Any preview images or materials shown before launch are illustrative and may differ from what is offered at launch.
c) Subscribing does not grant you an enforceable right of access, priority or reservation over any product.
A contract for the purchase of products can be concluded only after launch, under the terms of sale published in the store at that time.
IV. E-mail communications
We use your e-mail address to send you messages strictly related to the Waiting List and the launch: confirmation of your subscription, occasional pre-launch updates and the launch announcement itself. Subscribing to the Waiting List does not, by itself, subscribe you to a general marketing newsletter; if we offer one, it will require a separate sign-up.
You can unsubscribe at any time, free of charge, using the link included in every e-mail we send or by writing to mihai.pop@globencer.ro. Unsubscribing removes you from the Waiting List.
V. Launch benefits
We may announce benefits for Waiting List subscribers, such as early access or an introductory offer. Any such benefit is granted at our discretion, will be communicated together with its own conditions, may be limited in time or quantity and does not amount to a binding promise made through these Terms.
VI. Use of the Page
You must not subscribe using another person's e-mail address without their consent or use automated means to interact with the Page. We may remove entries obtained in breach of this requirement.
VII. Content on the Page
The content and materials displayed on the Page, including the Artency name and logo, artworks, images, graphics and text, are owned by or licensed to GLOBENCER SRL and are protected by intellectual property law.
You may view the Page for personal, non-commercial purposes. You must not reproduce, distribute or otherwise use its content without our prior written consent.
VIII. Availability and changes to the Page
The Page and the Waiting List are provided free of charge, "as is" and "as available". We may change, suspend or discontinue the Page or the Waiting List at any time. If we close the Waiting List before launch, we will delete the related subscription data as described in the Privacy Policy.
IX. Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for damage caused with intent or through gross negligence, or any other liability that cannot be excluded or limited under applicable law. Nothing in these Terms affects the rights you have as a consumer under mandatory legal provisions.
Subject to the paragraph above, and given that the Waiting List is a free notification service, we are not liable for loss of profit, loss of opportunity or other indirect damage connected with the Page or the Waiting List, or for:
a) An e-mail not reaching you because of spam filters, an incorrectly entered address or circumstances attributable to your e-mail provider.
b) The temporary unavailability of the Page.
c) Decisions you take in reliance on an indicative launch date.
X. Personal data
Information about how we process personal data in connection with the Page and the Waiting List is set out in the Privacy Policy and the Cookie Policy published on the Page. Please read them before subscribing.
XI. Changes to these Terms
We may amend these Terms, for example to reflect changes in the law or in the way the Waiting List operates. The current version, with its date, is published on the Page. If a change materially affects your rights, we will notify subscribers by e-mail reasonably in advance. If you do not agree with a change, you can unsubscribe at any time.
XII. Governing law and disputes
These Terms are governed by Romanian law. If you are a consumer habitually resident in another country, you also keep the protection of the mandatory provisions of the law of that country.
If you have a complaint, please contact us first at mihai.pop@globencer.ro; we will try to resolve it amicably. Disputes that cannot be resolved amicably are settled by the competent Romanian courts. Where the law so provides, you may also bring or defend proceedings before the courts of your own domicile.
XIII. Miscellaneous
a) If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue to apply.
b) A failure by us to enforce a provision of these Terms is not a waiver of that provision.
c) We may transfer our rights and obligations under these Terms to an affiliate or to a successor of the business, with notice to you, provided that the transfer does not materially reduce your rights under these Terms. You may not transfer your place on the Waiting List.

Privacy Policy

I. Introduction
This Privacy Policy explains how GLOBENCER SRL, with its registered office at Str. Infratirii nr. 45 A, 410251 Oradea, Bihor County, Romania, registered with the Trade Register under no. J2018000648058 and tax identification code (CUI) 39054634 ("Artency", "we", "us" or "our"), processes personal data in connection with the pre-launch page at www.artency.com (the "Page") and its Waiting List.
GLOBENCER SRL is the controller of the personal data described in this Privacy Policy for the purposes of Regulation (EU) 2016/679 (the "GDPR"). You can contact us about this Privacy Policy or your personal data at mihai.pop@globencer.ro.
This Privacy Policy applies only during Artency's pre-launch phase. We will publish an updated privacy policy when the Artency store opens.
II. Data We Collect
We collect only the personal data needed to operate the Page and the Waiting List:
- Waiting List data. When you join the Waiting List, we collect your email address, the date and time of subscription, your record of agreement to the Terms of Service, and your subscription status, including any unsubscription.
- Information you send us. If you contact us, we collect the contact details you use and the content of your message. Please do not send us special-category personal data, such as health information or information about your religious beliefs.
- Technical and cookie data. When you visit the Page, Shopify records limited technical information needed to operate and secure the Page. We also use cookies and similar technologies as described in our Cookie Policy. Non-essential cookies are used only with your consent.
III. How and Why We Use Your Data
We use your personal data for the following purposes:
- To operate the Waiting List. We use your Waiting List data to register your subscription, send your subscription confirmation and notify you about the launch of Artency and matters directly related to your Waiting List subscription. This processing is based on our legitimate interest in operating the Waiting List and providing the notification you requested.
- To manage records and respond to you. We use subscription records, unsubscription records and correspondence to respond to enquiries, honour your choices, maintain appropriate records and establish, exercise or defend legal claims. This processing is based on our legitimate interests in operating the Page responsibly and protecting our rights.
- To operate and protect the Page. We use technical data to maintain the security and functionality of the Page, prevent abuse and resolve technical issues. This processing is based on our legitimate interests in operating a secure and reliable Page.
- To use non-essential cookies. We use non-essential cookies and similar technologies only where you have given consent through the cookie banner. You may withdraw or change your cookie choices at any time through the available cookie settings.
- To comply with legal obligations. We may process or disclose personal data where necessary to comply with applicable law or a valid request from a competent authority.
Joining the Waiting List does not automatically subscribe you to general marketing communications. We do not sell personal data or use Waiting List data for third-party advertising.
IV. Who We Share Data With and International Transfers
We share personal data only where necessary with:
- Shopify International Limited (Ireland). Shopify provides the platform that hosts the Page, operates the subscription form and delivers our emails. Shopify acts on our behalf and may use its affiliates and authorised sub-processors to provide those services.
- Service providers supporting the operation of the Page. These providers may include IT and support providers. They may access personal data only as needed to provide services to us and are subject to appropriate confidentiality and data-protection obligations.
- Public authorities. We may disclose personal data where required by law or in response to a valid request from a competent authority.
- Business successors. Personal data may be transferred in connection with a merger, acquisition or other business reorganisation, subject to appropriate confidentiality and data-protection safeguards.
Some recipients, including Shopify and its service providers, may process personal data outside the European Economic Area. Where this occurs, we use safeguards recognised under the GDPR, such as an adequacy decision, the EU-US Data Privacy Framework where applicable, or Standard Contractual Clauses. You may request further information about the applicable safeguards at mihai.pop@globencer.ro.
V. Retention
We keep your Waiting List data while you remain subscribed. If you unsubscribe, we remove your email address from the Waiting List and retain only the minimum information needed to honour your unsubscription and demonstrate compliance.
After Artency launches, we will retain Waiting List data only for as long as reasonably necessary to complete the Waiting List communications and maintain appropriate compliance records. If you become a customer or separately subscribe to other communications, your data will be processed as described in the privacy information applicable to those services. If the Waiting List is discontinued before launch, we will delete the related subscription data.
We retain correspondence and technical data only for as long as reasonably necessary for the purpose for which they were collected. We may retain data for longer where required by law or necessary to establish, exercise or defend legal claims.
VI. Your Rights
Subject to the GDPR, you have the right to request access to your personal data, correction of inaccurate data, deletion of data, restriction of processing, and portability of data you have provided to us. You may also object to processing based on legitimate interests and withdraw your consent at any time where processing is based on consent. Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.
To exercise your rights, email mihai.pop@globencer.ro. We may request information needed to verify your identity. You also have the right to lodge a complaint with the Romanian data-protection authority, ANSPDCP, at www.dataprotection.ro, or with the supervisory authority in your place of residence or work.
VII. Security
We use appropriate technical and organisational measures to protect personal data against unauthorised access, loss, misuse or disclosure.

We may update this Privacy Policy from time to time. The current version and its effective date will be published on the Page. If a change materially affects you, we will provide notice by email or on the Page where appropriate.
